DUI Deferred Prosecution and Drug Court Cases

If you successfully completed drug court for any drug related felony or misdemeanor offense and the charge was dismissed and/or nol prossed OR you successfully completed a dui deferred program or alternate prosecution plan whereby the dui charge was dismissed and/or nol prossed ......... then, depending on the date of the dismissal  your case(s) is/are eligible for expungment.  Successful Veteran Court and Mental Health Court Defendants may also be eligible.

Non-Violent Offenses

If you were arrested and charged with a non-violent offense (see below for examples of violent crimes)  AND your charge was either dismissed with prejudice, dismissed without prejudice (special restrictions apply), no billed by a grand jury,  OR you were found not guilty at trial.........then, depending on the date of the disposition, your case(s) is/are eligible for expungement.

Offenses Not Eligible for Relief

If a conviction followed your charge and arrest of any offense, felony or misdemeanor, then that particular charge is not eligible for expungement under the Alabama Statute.  Similarly, crimes that are categorized as Violent Offenses are not eligible despite the favorable disposition in a court of law.  Factors which are considered which yield classification into the "violent classification" include involvement of a deadly weapon, substantial risks of physical injury to a third party, non-consensual sex offenses, or acts that otherwise are considered reprehensible.    A non-exhaustive list of these crimes are murder, manslaughter, negligent homicide, Assaults I & II, Kidnapping I & II, Rape I & II, Sodomy I & II, Sexual Torture, Sexual Abuse I, Stalking, Aggravated Stalking, Domestic Violence I & II, Burglary I, II, & III*, Arson, Extortion I, Robbery I, II, & III, Terrorist Threats, Escape I, Intimidating a Witness or Juror, Treason, Trafficking, Child Abuse, and Elder Abuse.
